1. Acceptance of Terms
By accessing or using Viuzen, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
These Terms of Service ("Terms") govern your access to and use of Viuzen ("Platform," "we," "us," or "our"), operated by Powered Up Web LLC. By creating an account or using any part of the platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are using Viuzen on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.
2. Accounts and Eligibility
Eligibility
You must be at least 18 years of age to create an account and use Viuzen. By registering, you represent and warrant that you meet this age requirement.
Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised use of your account.
One Account Per Person
You may not create multiple accounts or use another person's account. We reserve the right to suspend or terminate duplicate accounts.
Account Types
- Members — can browse content, follow creators, and send fruit gifts.
- Creators — can upload videos, receive fruit gifts, and withdraw earnings via Stripe Connect.
3. User Content
Your Content
You retain ownership of any content you upload to Viuzen ("User Content"). By uploading content, you grant Viuzen a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your content on the platform for the purpose of providing the service.
Content Standards
All content uploaded to Viuzen must be related to plant-based living, wellness, nutrition, mindfulness, or closely related topics. You agree not to upload content that:
- Is illegal, harmful, threatening, abusive, or defamatory
- Contains nudity, sexual content, or graphic violence
- Promotes hatred, discrimination, or harassment
- Infringes any third-party intellectual property rights
- Contains spam, misinformation, or misleading health claims
- Violates any applicable laws or regulations
Platform Promotional Use
By uploading content to Viuzen, you grant Powered Up Web LLC a non-exclusive, royalty-free, worldwide licence to use short clips or snippets of your videos (typically under 60 seconds) in promotional materials, advertisements, and marketing campaigns whose sole purpose is to promote the Viuzen platform. This may include use in paid social media ads, platform previews, app store listings, and similar promotional contexts.
We will never use your full video in advertising, sell your content to third parties, or use your content to promote any service other than Viuzen. Creator attribution will be included wherever practical.
If you do not wish your content to be used in platform promotion, you may opt out at any time by contacting us at [email protected]. Opting out will not affect your ability to use any part of the platform.
Content Removal
We reserve the right to remove any content that violates these Terms without notice. Repeated violations may result in account termination.
4. Fruit Points and Payments
What Are Fruit Points?
Fruit Points ("FP") are a virtual currency used within the Viuzen platform to send gifts to creators. Each Fruit Point has a gifting value of $0.10 USD — meaning 10 FP = $1.00 in gift value delivered to a creator. When a member gifts FP to a creator, those points convert to real USD earnings that the creator can withdraw via Stripe. FP purchased by members, however, have no cash value for the purchasing member and cannot be refunded or exchanged for currency.
Purchasing Fruit Points
FP may be purchased through our secure payment processor (Stripe) in the bundles shown on the wallet page. All prices are in USD. Every FP you purchase goes directly toward supporting creators on the platform.
Non-Refundable Policy
All Fruit Point purchases are final and non-refundable. FP purchased by members cannot be refunded, transferred between accounts, or exchanged for currency by the purchasing member. FP are forfeited upon account deletion or termination. Note: when gifted to a creator, FP convert to real USD earnings for that creator — your support has real value to them.
Once Fruit Points are gifted to a creator, the transaction is permanent and cannot be reversed. We do not offer refunds for FP purchases except where required by applicable law.
Expiry
Fruit Points do not expire as long as your account remains active. FP in suspended or deleted accounts are forfeited.
5. Creator Terms
Becoming a Creator
Any member may upgrade to a creator account at no cost. By becoming a creator, you agree to additional responsibilities including compliance with content standards and applicable tax obligations.
Earnings
Creators receive 80% of the USD value of every gift they receive. At a gifting rate of $0.10 per FP, a creator who receives a Strawberry (10 FP) earns $0.80; a Fruit Basket (250 FP) earns $20.00.
Platform Fee
Viuzen retains 20% of each gift as a platform fee. This fee covers payment processing, hosting, platform infrastructure, and ongoing development — ensuring Viuzen can continue to deliver the best possible experience for both creators and members. The platform fee is deducted automatically; creators always see their net earnings in the creator dashboard.
Withdrawals
Creators may withdraw earnings at any time via Stripe Connect once their balance reaches the minimum threshold of $25.00. Withdrawals are processed within 2–5 business days. You are responsible for providing accurate banking information and for any applicable taxes on earnings received.
Tax Responsibility
Creators are solely responsible for reporting and paying any taxes on earnings received through Viuzen. We may issue tax documentation as required by law. We recommend consulting a tax professional regarding your obligations.
Creator Content Responsibility
Creators are solely responsible for all content they upload. You represent that you own or have the necessary rights to all content you upload, and that your content does not violate any third-party rights or applicable laws.
6. Early Access and Gated Content
What Is Early Access?
Creators may designate certain videos as "Early Access," making them available exclusively to viewers who have gifted a specified number of Fruit Points on that video. Once a viewer meets the gifting threshold, they retain access to that video for as long as their account is active.
No Guaranteed Duration
Creators may remove or edit their content at any time. Viuzen does not guarantee continued availability of any specific early access video. Fruit Points gifted to unlock early access are subject to the same non-refundable policy as all other gifts.
Creator Responsibility
Creators who enable early access are responsible for ensuring the content they gate meets all platform content standards. Gating content behind early access does not exempt it from these Terms.
7. Video Amplification
What Is Video Amplification?
Creators may pay to amplify ("boost") their videos, increasing their visibility across discovery pages, search results, and other platform placements. Amplification is purchased for a specified duration at a daily rate and is subject to availability and placement rules set by Viuzen.
Payments
Amplification fees are charged in full at the time of purchase via Stripe. By purchasing a boost, you authorise Viuzen to charge your payment method for the total amount shown at checkout.
Cancellation and Refunds
You may cancel an active boost at any time. Refunds are prorated based on unused days remaining: you will receive a refund for the portion of the boost period that has not yet been served, minus any days already elapsed. Same-day cancellations may receive a full refund at our discretion. Refunds are returned to your original payment method within 5–10 business days.
Viuzen reserves the right to remove a boost without refund if the associated video violates these Terms or is otherwise ineligible for promotion.
No Guaranteed Results
Amplification increases the visibility of your content but does not guarantee a specific number of views, followers, or gifts. Viuzen makes no representation about the performance of any boosted video.
9. Social Features
Following Creators
Members may follow creators to receive updates when new content is published. Following is free, voluntary, and public — creators can see their total follower count. You may unfollow a creator at any time.
Likes
Members may like videos to express appreciation. Likes are public and visible on the video. You may remove a like at any time. Likes have no monetary value and do not affect creator earnings.
Notifications
Following a creator or engaging with content may result in you receiving email notifications. See Section 10 for details on how to manage these communications.
10. Email Communications
Transactional Emails
By creating an account, you agree to receive transactional emails necessary for the operation of the platform. These include:
- Account registration and password reset emails
- Gift and earnings notifications (creators)
- New follower notifications (creators)
- New comment and reply notifications
- Video publishing and processing confirmations (creators)
- New video notifications from creators you follow
- Payout and withdrawal confirmations
Marketing Emails
We may occasionally send platform updates or promotional emails. You may opt out of marketing emails at any time by clicking the unsubscribe link in any such email or by contacting [email protected]. Opting out of marketing emails does not affect transactional emails, which are required for account operation.
Email Accuracy
You are responsible for keeping your email address current. Viuzen is not liable for missed communications resulting from an outdated or incorrect email address on your account.
11. Prohibited Conduct
You agree not to engage in any of the following:
- Using the platform for any illegal purpose
- Attempting to hack, reverse-engineer, or compromise platform security
- Creating fake accounts, impersonating others, or manipulating engagement
- Spamming, harassing, or threatening other users
- Selling, transferring, or commercialising your account
- Using automated tools, bots, or scrapers on the platform
- Uploading malware, viruses, or harmful code
- Attempting to circumvent content restrictions or account suspensions
- Making fraudulent purchases of Fruit Points via stolen payment methods
Violations may result in immediate account suspension or termination without refund of any FP balance.
12. Intellectual Property
The Viuzen name, logo, design, and all platform software are owned by Powered Up Web LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our written permission.
If you believe any content on Viuzen infringes your intellectual property rights, please contact us at [email protected] with details of the alleged infringement.
13. Termination
You may delete your account at any time through the Edit Profile page. Upon deletion, your personal data will be anonymised, your videos will be removed, and any unspent Fruit Points will be forfeited.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if your account poses a risk to the platform or other users. In such cases, any FP balance is forfeited and no refund will be issued.
14. Disclaimers and Limitation of Liability
No Medical Advice
Content on Viuzen is for informational and entertainment purposes only. Nothing on the platform constitutes medical, nutritional, or health advice. Always consult a qualified healthcare professional before making changes to your diet, exercise routine, or health practices.
Platform Availability
Viuzen is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access to the platform and may perform maintenance at any time.
Limitation of Liability
To the maximum extent permitted by law, Powered Up Web LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Viuzen, including but not limited to loss of data, revenue, or content.
15. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Florida.
16. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes by posting a notice on the platform or sending an email to registered users. Your continued use of Viuzen after changes take effect constitutes your acceptance of the updated Terms.
